Under the Drugs and Cosmetics Act 1945, The Health Ministry has almost introduced a new Schedule HX with finalised norms and rules. A Schedule HX drug would come with a label warning, “Dangerous to take this preparation except in accordance with medical advice and not to be sold on retail without prescription of a registered medical practitioner.” Part A of Schedule HX is only to tertiary hospitals and Part B is mainly against prescription only. Violations will be punished with a fine of Rs. 20,000 or up to 2 years imprisonment. It will be added to the Drugs & Cosmetics Act to make it compulsory to carry duplicate prescriptions. Schedule HX is needed for new set up of laws to regulate the sale of antibiotics and for the purpose of check the abuse of antibiotics. It also regulates Anti TB drugs, Habit forming drugs, Cough syrups, Painkillers, Sedatives and Anti-Anxiety drugs. Schedule HX is not patient as well as chemist friendly.
